The Chamber Judge Court of the Appellate Division has stayed the High Court's order to reinstate Amartya Roy's candidacy for the VP post in the Jahangirnagar University Central Students' Union (JUCSU) election.
As a result, Amartya Roy will not be able to participate in the JUCSU elections, according to his lawyer.
On Tuesday, Justice Md Rezaul Haque of the Appellate Division's Chamber Judge Court issued the stay order after hearing an appeal filed by Jahangirnagar University against the High Court's directive.
Advocate Mohammad Shishir Monir represented Jahangirnagar University in court, while Advocate Manzur Al Matin appeared on behalf of the writ petitioner.
Earlier in the day, a bench of the High Court had ordered that Roy's candidacy for the VP post be reinstated. Jahangirnagar University appealed this decision to the Chamber Judge Court the same afternoon.
Upon hearing the appeal, the Chamber Court stayed the High Court's order.
On 6 September, just five days before the polls, the JUCSU Election Commission announced the cancellation of Roy's candidacy.
It said the decision had been made since Roy was not a regular student.
JU Proctor Professor AKM Rashidul Alam later clarified that Roy had been declared irregular as he had not completed his undergraduate degree, failing course 408 twice.
Roy, admitted to the archaeology department in 2017–18, filed a writ petition challenging this decision on Monday.
On Monday, a writ petition was filed with the relevant High Court branch seeking reinstatement of Amartya Roy's VP candidacy for the JUCSU elections.
Supreme Court lawyer Manzur Al Matin filed the petition on behalf of Roy.
Speaking to reporters, Matin said that Amartya was a VP candidate from the "Sampriti'r Oikko" panel.
"There's a timeline for everything — candidacy declarations, voter list publication, and nomination scrutiny. After the scrutiny process, there's usually an opportunity to appeal. After all these processes had concluded and just days before the election, Amartya suddenly learned that his candidacy had been canceled," said the lawyer.
"He was not given any opportunity to be heard, nor was he issued any formal notice. Violating all standard procedures, the university authorities canceled his candidacy," Matin added. That is why Amartya filed the writ petition, he explained.
