There is no bar on SM Farhad, the president of Islami Chhatra Shibir's DU unit, participating in the Dhaka University Central Students' Union (DUCSU) elections, the Appellate Division of the Supreme Court ruled on Wednesday after hearing a writ challenging his candidacy.
The bench earlier in the day also upheld the Chamber Court's order suspending the High Court's directive regarding postponing the polls, meaning the election will be held as scheduled on 9 September.
The Appellate Division bench was headed by Chief Justice Syed Refaat Ahmed.
Mohammad Shishir Manir represented Dhaka University, Ahsanul Karim and Jyotirmoy Barua participated in the hearing on behalf of the writ petitioner, and Imran A Siddique represented SM Farhad.
On Tuesday, Appellate Division Chamber Justice Farah Mahbub fixed Wednesday for the hearing.
Farhad is running for the post of General Secretary (GS) from the "Oikkoboddho Shikkharthi Sangsad", supported by Chhatra Shibir.
BM Fahmida Alam challenged the validity of his candidacy in a writ petition to the High Court on 28 August, alleging that he was associated with the banned organisation Chhatra League.
Fahmida is a candidate of the Liberation War and Democratic Movement Affairs Secretary of the Oporajeyo 71- Odommyo 24 panel nominated by the left alliance in the DUCSU elections.
