The Appellate Division, led by Chief Justice Syed Refat Ahmed, on Wednesday upheld the Chamber Court's order suspending the High Court's directive regarding the Dhaka University Central Students' Union (DUCSU) election.
As a result, there is no bar to holding the DUCSU election on 9 September, the lawyers said.
A hearing on the matter began in the full bench of the Appellate Division headed by Chief Justice Syed Refat Ahmed around 11:20am today.
Advocate Mohammad Shishir Monir represented Dhaka University in the court.
On behalf of the petitioner BM Fahmida Alam, advocates Ahsanul Karim and Jyotirmoy Barua took part in the hearing, while advocate Imran A. Siddiq represented S. M. Farhad, against whom the petition was filed, challenging his candidacy for the DUCSU polls.
On Tuesday, the Appellate Division upheld the stay order on the High Court's directive to suspend the Dhaka University Central Student Union (DUCSU) election, saying it will remain in effect until Wednesday, when a full bench will hold a hearing on the matter.
On Monday, about an hour after a High Court (HC) order suspended the DUCSU election until 30 October centring a civil miscellaneous petition, the Appellate Division stayed the order.
On August 28, BM Fahmida Alam – contesting the post of Secretary for the Liberation War and Democratic Movement under the 'Oporajeyo 71, Odommo 24' panel – filed a writ petition with the High Court challenging SM Farhad's candidacy.
On Monday, Fahmida's panel alleged that she had received threats of being gang-raped after filing the writ. The University Teachers Network on Tuesday called for exemplary punishment against those making such threats.
According to the announced schedule, the voting for the Dhaka University Central Student Union (DUCSU) election is scheduled to be held on September 9.
Student organisations, including Chhatra Dal, Chhatra Shibir, Democratic Student Union, and left-wing student groups have already announced panels - both full and partial.
A total of 471 candidates, including 62 female candidates, are contesting 28 posts.
The highest number of contestants is for the membership positions, with 217 candidates.
In 18 halls of Dhaka University, a total of 1,035 candidates are competing for 13 posts in the final round.
